1. Acceptance of Terms
By accessing or using the Butterfly RX platform, website, or any related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services. These Terms constitute a legally binding agreement between you and Butterfly RX, Inc.
2. Description of Services
Butterfly RX provides a telehealth platform connecting patients with licensed healthcare providers for perimenopause and menopause care, including hormone replacement therapy (HRT) consultations, at-home lab testing coordination, and prescription management. Our Services are available only to individuals who are at least 18 years of age and reside in states where our licensed providers are authorized to practice.
3. Medical Disclaimer
The information provided through our Services is for informational and educational purposes only and does not constitute medical advice. All medical decisions are made by licensed physicians who are independent contractors. Butterfly RX does not practice medicine and does not employ physicians. Results may vary. Always consult your primary care provider before starting any new treatment.
4. Account Registration
To access certain features of our Services, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
5. Affiliate Program
Participation in the Butterfly RX Affiliate Program is subject to additional terms and conditions. Affiliates earn commissions for referring new patients who complete a qualifying purchase. Commission rates, payment schedules, and program rules are subject to change with 30 days' notice. Butterfly RX reserves the right to suspend or terminate affiliate accounts for violations of program terms, fraudulent activity, or any conduct deemed harmful to the company or its patients.
6. Payment and Refunds
All fees are charged at the time of service unless otherwise stated. Prescription medications and lab testing fees are non-refundable once dispensed or processed. Consultation fees may be refunded within 24 hours of scheduling if the appointment has not yet occurred. Please contact our support team for billing inquiries.
7. Intellectual Property
All content, trademarks, logos, and intellectual property on the Butterfly RX platform are owned by or licensed to Butterfly RX, Inc. You may not reproduce, distribute, or create derivative works without our express written permission.
8. Limitation of Liability
To the maximum extent permitted by law, Butterfly RX shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Services. Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim.
9. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules.
10. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by email or by posting a notice on our platform. Your continued use of the Services after any changes constitutes your acceptance of the new Terms.
